Service Agreement  

Upon hiring a CANDIDATE/EMPLOYEE presented by Adelante Staffing Services Inc.
I hereby agree to the following terms and conditions:

Adelante Staffing Services, Inc. shall recruit, screen, hire, and assign CANDIDATES/EMPLOYEES to job assignments designated by CLIENT/EMPLOYER. Minimum length of each assignment shall be four (4) hours, per request, per CANDIDATE/EMPLOYEE, per day.
 
CLIENT/EMPLOYER agrees that Adelante Staffing shall not be responsible for failing to find, present, or place CANDIDATES/EMPLOYEES for specific Staff Requests submitted to Adelante Staffing by CLIENT/EMPLOYER. Adelante Staffing shall not be responsible for failing to provide the CANDIDATE/EMPLOYEE requested if said CANDIDATE/EMPLOYEE are unavailable and CLIENT/EMPLOYER has been notified at least twenty-four (24) hours in advance.

CLIENT/EMPLOYER shall provide Adelante Staffing with at least twenty four (24) hours notice prior to the cancellation of any Staff Request already submitted to Adelante Staffing. Failure to provide such notice will entitle Adelante Staffing to a minimum fee equal to four hours of time billable at the rate specified in the Adelante Staffing fee schedule.
Time and one-half will be paid for hours and fractions of hours worked over the limits prescribed by the local, state, and federal laws governing CLIENT/EMPLOYER’s place of business. Overtime exceeding applicable regulatory limits must be approved by Adelante Staffing in advance.

CLIENT/EMPLOYER shall provide parking for CANDIDATE/EMPLOYEE or reimburse CANDIDATE/EMPLOYEE for any parking fees incurred.
CLIENT/EMPLOYER shall provide the Adelante Staffing CANDIDATE(S)/EMPLOYEES(S) with reasonable work accommodations similar to those it provides its other personnel of equal title or status.All communication regarding staffing (schedules, changes,cancellations, requests) shall be communicated specifically to the assigned Adelante Staffing Client Services Manager and not to a field representative or other member of the Adelante Staff. It is expressly agreed upon that no CANDIDATE/EMPLOYEE assigned or placed by Adelante Staffing shall have authority to bind Adelante Staffing in any manner.
While the Adelante Staffing, CANDIDATE/EMPLOYEE shall be limited to performing those job responsibilities outlined by the CLIENT/EMPLOYER on the Adelante Staffing request form. Noncompliance with this policy may result in immediate removal of the CANDIDATE/EMPLOYEE from the assignment. CLIENT/EMPLOYER shall ensure that CANDIDATE/EMPLOYEE is given a reasonable caseload, not exceeding that which is expected of its own personnel.

CANDIDATES/EMPLOYEES may request time off from CLIENT/EMPLOYER and gain approval only at the CLIENT/EMPLOYER(S) discretion and with reasonable notice. CLIENT/EMPLOYER may request copies of Adelante Staffing policies and procedures that relate to the CANDIDATE/EMPLOYEES on assignment including but not limited to Sexual Harassment and Health and Safety policies.

CLIENT/EMPLOYER agrees to provide direct supervision and training to the Adelante Staffing CANDIDATES/EMPLOYEES and agrees that Adelante Staffing CANDIDATE/EMPLOYEES will only be employed by the CLIENT/EMPLOYER’s place of business as provided in the Adelante Staffing request form. CLIENT/EMPLOYER further agrees that Adelante Staffing CANDIDATE/EMPLOYEES shall not be permitted to, without advance approval by a Senior Manager of Adelante Staffing to:(a) engage in travel or otherwise operate a motor vehicle or motorized equipment on behalf of CLIENT/EMPLOYER, (b)handle cash, valuables or negotiable instruments, or (c) access unsupervised or uncontrolled confidential information.

No guarantees or representations, implicit or explicit, are made beyond those set forth in this Staffing Services Terms and Conditions. In accepting the services of Adelante Staffing, it is agreed that in the unlikely event of litigation as to any terms of this Agreement, The CLIENT/EMPLOYER shall pay reasonable court costs, collection costs, and/or attorney fees when so ordered by a court of law.

I, the CLIENT/EMPLOYER have read and understand the attached Adelante Staffing Services Fee Schedule and Staffing Services Terms and Conditions, and agree to its terms. Furthermore, I agree that all future staffing services provided by Adelante Staffing Services, Inc. will be subject to the same Fee Schedule and Staffing Services Terms and Conditions, including any amendments to the terms contained therein of which I am notified. I agree to not solicit for hire, directly or indirectly, any CANDIDATE/EMPLOYEE introduced to me through my relationship with Adelante Staffing Services, Inc. for a period of at least twelve (12) months following the later of (i) my learning of the CANDIDATE/EMPLOYEE or (ii) termination of the CANDIDATE/EMPLOYEE contract assignment with me. In the event that I hire an Adelante Staffing, Inc. CANDIDATE/EMPLOYEE in violation of the foregoing, Adelante Staffing Inc. shall be entitled to immediate payment of its applicable fees to the Fee Schedule then in effect.
